Order BEFORE: LIVELY and JONES, Circuit Judges; and BALLANTINE,* District Judge. In this case charging violation of 18 U.S.C. 脙茠芒€拧脙‚脗§ 2113(b) the defendants tendered guilty pleas to the court. At the suggestion of the district court, the defendants withdrew their guilty pleas and pleaded nolo contendere. The district court accepted the pleas of nolo contendere and stated, ""[An] adjudication of guilty will be entered thereon...."" Sentencing was deferred. At the subsequent sentencing hearing, acting sua sponte, the district court stated, ""These cases are dismissed...."" Thereafter the district court entered a written judgment in which it purported to dismiss the indictments.
